Terms of Service

Short version: Use GymOS to recover your gym's failed payments. Pay your subscription, don't misuse the service, and we'll keep everything running. Cancel anytime.

1. Acceptance

By accessing or using GymOS ("the Service"), operated by Meraki ("we", "us", "our"), you agree to these Terms. If you do not agree, do not use the Service.

2. What GymOS does

GymOS connects to your Stripe account to detect failed membership payments and automatically sends WhatsApp messages to your gym members to help recover those payments. The Service does not initiate, move, or otherwise handle funds on your behalf.

3. Eligibility

You must be at least 18 years old and authorised to act on behalf of the gym or fitness business you register.

4. Account and setup

You are responsible for providing accurate information during onboarding, including your Stripe Account ID. Notify us at gymostool@gmail.com if your Stripe account or gym software changes.

5. Subscription and payment

Free trial

New accounts receive a 30-day free trial. No charge is made during this period. A valid card is required to activate the trial — it will be charged automatically on day 31 unless you cancel first.

Billing

Subscriptions are billed monthly or annually via Stripe. By providing payment details you authorise us to charge your card on a recurring basis.

Cancellation

You may cancel at any time from your Stripe billing portal or by emailing us. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial periods.

Refund guarantee

If GymOS does not recover more than it costs in your first paid month, contact us within 30 days and we will issue a full refund for that month, no questions asked.

Your use of the Service is also governed by our Privacy Policy. By using GymOS you confirm that you have the legal right to share your gym members' phone numbers with us for payment recovery communications.

8. Third-party services

GymOS integrates with Stripe, Meta WhatsApp Business API, and other third-party services. Your use of those services is governed by their respective terms. We are not responsible for their availability or conduct.

9. Intellectual property

All software, code, design, and content comprising GymOS is owned by Meraki. You receive a limited, non-exclusive, non-transferable licence to use the Service during your active subscription.

10. Disclaimers

The Service is provided "as is." We make no guarantee that GymOS will recover any specific amount of revenue. Recovery rates depend on factors outside our control, including your members' willingness to update their card details and Stripe's own retry behaviour.

11. Limitation of liability

To the maximum extent permitted by law, Meraki's total liability for any claim is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

12. EU consumer rights

If you are an EU consumer (not a business), you may have a 14-day right of withdrawal from digital services. This right is waived if you have already actively used the Service during the trial period.

These terms are governed by the laws of Spain. Disputes are subject to the exclusive jurisdiction of the courts of Barcelona, unless mandatory consumer law in your country requires otherwise.

14. Changes

We may update these terms at any time. We will notify active subscribers by email at least 14 days before material changes take effect.
